3. What information do we collect and from where?

 

If you are a User of the Website, we collect information provided to us through forms on the Website and recorded during your use of the Website. These include, in particular, your name, contact information.

 

If you are an end customer, we collect information that you provide to us through forms on the Website, contact by phone, e-mail or through social media profiles, as well as data that we receive from our Contractors, e.g. in connection with complaints. These include, in particular, your name, contact information

 

If you are a Contractor, we collect information provided to us through contact forms on the Website, in the Partner Zone, in documents you send us, during conversations, email exchanges and meetings, including in particular information necessary for the conclusion and execution of the contract. This may include, in particular, your name, surname, company, business address, PESEL, NIP, REGON, bank account number. Your data may also come from public sources.

 

If you are a Representative of a Contractor, we collect information provided to us through contact forms on the Website, in the Partner area, during conversations, email exchanges, meetings. This may include, in particular, your name, surname, contact details, position, data about the entity you represent, data needed for us to conclude a contract with this entity, if necessary for this purpose. Your data may also be provided to us by the entity you represent both before and in the course of cooperation with us.

 

If you are a Job Candidate we collect information you provide to us in your resume or other application document as part of the recruitment process. This may include, in particular, your name, date of birth, contact information, education, professional qualifications and history of previous employment, as well as other personal information you provide to us on your own initiative. Remember that your provision of personal data to the extent required by law, including Article 221 § 1 and 4 of the Labor Code, is necessary to participate in the recruitment procedure. Provision of other data is voluntary, and failure to provide them will not result in any negative consequences for you, in particular will not constitute a reason justifying refusal of employment.

 

4. For what purpose and on what basis we process your data

 

As a rule, we process your personal data:

  1. with your consent (as long as it is a valid and effective basis for data processing) (Article 6(1)(a) of the DPA), to:
  1. when it is necessary to comply with obligations imposed on us by law (Article 6(1)(c) RODO);
  2. when it is necessary to pursue our legitimate interests (Article 6(1)(f) of the DPA), when:

If you are an end customer, we process your personal data in order to perform the service (Art. 6(1)(b) GDPR) or based on a legitimate interest to handle complaints (Art. 6(1)(f) GDPR).

 

If you are a Counterparty, we process your personal data for the purpose of entering into and performing the contract (Art. 6(1)(b) GDPR).

 

If you are a Representative of a Counterparty, we process your personal data based on legitimate interest (Art. 6(1)(f) GDPR) to the extent that we maintain business relationships, conduct discussions or negotiations, enter into agreements, and resolve other matters related to cooperation with the entities you represent.

 

If you are a Job Candidate, we process your personal data based on your consent for future recruitment processes (Art. 6(1)(a) GDPR), and special category data, if you voluntarily provide them to us (Art. 9(2)(a) GDPR), or for the purpose of fulfilling legal obligations incumbent on the Administrator as an employer and corresponding to the rights of the job applicant, arising from legal provisions, including labor law regulations (Art. 6(1)(c) GDPR).

 

5. To whom do we disclose your data

 

When necessary to achieve the purposes for which we process your data, we may disclose them:

  1. to entities authorized to receive them under the law (e.g., courts, law enforcement authorities, administrative authorities, supervisory authorities, etc.);
  2. to entities processing personal data on our behalf, i.e., companies providing specific services on our behalf, involving the processing of personal data. For example, entities managing our IT systems or providing us with telecommunications tools, entities providing us with legal, accounting, advisory, consulting, marketing, or research services, recruitment portals, or recruitment agencies;
  3. to other entities within the capital group to which we belong, i.e., entities indirectly or directly associated with Cavec sp. z o.o.

If you are an end customer, we may disclose your data to our Counterparties, i.e., entities with whom we cooperate, for example, in handling complaints.

 

If you are a Counterparty or a Representative of a Counterparty, we may disclose your data to Users of the Website, provided that they are made available there.

 

In every case of sharing your data, we will ensure that only the minimum necessary information required to achieve the purpose of data processing is disclosed.

 

Your data will not be transferred outside the European Economic Area (EEA). In the event that your data were to be transferred outside the EEA, we will ensure that cooperation with such entities is based on an appropriate legal basis and that they provide adequate standards of protection.

 

6. How long do we retain your data

 

We store information about you for the period necessary to achieve the purposes outlined in this privacy policy and in accordance with our data retention policies (unless a longer period is required by applicable law). Our data retention policies are based on applicable legal requirements. We will retain and use information about you to the extent necessary to fulfill legal requirements (e.g., if we are required to retain information about you for tax purposes), resolve disputes, perform a contract, settlement, or as specified in this privacy policy.

In the case of processing based on your consent, we will store your data until its withdrawal, and thereafter for the period and to the extent required to pursue the legitimate interests of the administrator.

 

If you are a Candidate, we store your data until the end of the recruitment process, and longer only if you have consented to their processing for future processes.

 

7. What rights do you have

 

By exercising your rights regarding personal data processing, you can address the following requests to us:If we process your personal data based on your consent, you can withdraw this consent at any time; however, please note that withdrawing consent does not affect the lawfulness of processing based on your consent before its withdrawal;

  1. you can request access to your personal data and obtain a copy thereof;
  2. you can exercise your right to data portability, i.e., request us to provide your data in a structured, commonly used, machine-readable format, and you can also request us to transmit this data directly to another controller, if we process it in an automated manner based on your prior consent;
  3. you can request correction of your personal data if they are incorrect or incomplete;
  4. in relation to your particular situation, you can object to the processing of your personal data if we process them based on our legitimate legal interest; you can also object to the processing of your data for direct marketing purposes;
  5. in cases specified by law – e.g., if your data are outdated, unnecessary, processed unlawfully, or if you have withdrawn your consent to their processing (when consent was the basis for such processing) or successfully objected to the processing of your personal data – you can request deletion of your personal data;
  6. you can also request restriction of processing of data while we are considering your objection or complaint regarding the correctness of your personal data, their compliance with the lawfulness of processing of your data, or our legitimate interest, and if the data are needed by you for the purpose of establishing, investigating, or defending claims.

In any case where you believe that the processing of your personal data by us violates GDPR regulations, you also have the right to lodge a complaint with the President of the Personal Data Protection Office.

 

8. Are you required to provide us with your data

 

Providing your data is entirely voluntary, however, without providing them, we will not be able to achieve the purposes mentioned above, in particular, respond to your inquiries, present offers to you, enter into agreements with you, maintain business relationships, consider your application in the recruitment process, and so on.

 

If you are a Candidate, providing your personal data to the extent required by law, including Art. 22(1) § 1 and 4 of the Labor Code, is necessary to participate in the recruitment process. Providing other data is voluntary, and failure to provide them will not result in any negative consequences for you, especially will not constitute grounds for refusal of employment.

In addition, you have the right to lodge a complaint with the competent supervisory authority, i.e. the President of the Office for Personal Data Protection, if you consider that our processing of your data violates the provisions of the General Data Protection Regulation „RODO”.
